Resolution is a community of family justice professionals in the UK who work with families and individuals to resolve issues in a constructive way.  I have been a member of Resolution for over 25 years because I am passionate about trying to minimise the pain of conflict in divorce wherever possible.  Accordingly, like all of us in Resolution, I was delighted with the announcement that no-fault divorce is set to become reality after the Divorce, Dissolution and Separation Bill received

Picture of Emily from Nalders re Gas Safety

The Court of Appeal’s recent judgment in the case of Trecarrell House Ltd v Rouncefield will be a welcome relief to landlords who may have inadvertently breached the Gas Safety (Installation and Use) Regulations 1998 (“the Gas Regulations”).   Pursuant to the Gas Regulations landlords are to carry out an annual gas safety inspection and provide the tenant with a copy of the safety certificate within 28 days of the same. Article 36(6)(b) stipulates that a landlord must give a

The Divorce, Dissolution and Separation Bill passed its first vote in the House of Commons this week. If the Bill gets through the Parliamentary process it will bring in some big changes for people thinking about getting a divorce.  These are the intended changes:   Do away with the current need to provide evidence of conduct or separation facts: instead one person will need to produce a statement of irretrievable breakdown; This statement of irretrievable breakdown would be taken as

You have probably heard the phrase ‘the New Normal’ in the news recently to describe different working arrangements all businesses have had to use due to the COVID 19 pandemic.  The Family Law department at Nalders is no exception.  We have had to assess how we work to comply with the social distancing and lockdown requirements.  We are conducting meetings via Zoom or by telephone conferencing to prevent unnecessary travel or contact; some court hearings are also being conducted this

Coronavirus Job Retention Scheme and ‘Furlough Leave

HMRC have updated the Coronavirus Job Retention Scheme guidance (again!). The most significant change is that the Scheme is now extended to cover those who were on payroll by 19 March rather than 28 February. This will mean a number of people who changed jobs after 28th February may now fall within the Scheme.   How can Nalders help? We are up to speed with the latest developments regarding the Covid-19 pandemic and are highly experienced in employment and business

Kieran O'Sullivan from Nalders talking about energy performance certificates

Before you market your house for sale you or offer it for rent it is a legal requirement that you have in place a valid Energy Performance Certificate (EPC).   An EPC is valid for 10 years so it is worth checking the EPC Register to see if your property already has one in place.   If you don’t have a valid EPC the Ministry of Housing, Communities and Local Government has published guidance on EPCs during the Covid-19 outbreak.

f Lee from Nalders on Job Retention Scheme

HMRC online portal   Senior representatives from HMRC appeared before the Parliamentary Select Committee yesterday and discussed the Coronavirus Job Retention Scheme.   Key information arising from that discussion were:-   The online portal to claim reimbursement is expected to be up and running on 20th April 2020. The first payments are expected to be made around 30th April 2020. If an employer’s payroll runs weekly, claims can be submitted to HMRC weekly. Note that this is different from the

We are all following the ‘lockdown’ rules Boris Johnson imposed on us on 23 March 2020. Staying at home is supposed to be one of the safest places to be at present however for a number of men and women it is not. For them, it is prison of intimidation, violence and threats.   Covid-19 and the economic shut down also brings the additional finances, health and domestic  pressures which can result in an increase in domestic abuse.   Victims

Mark Buswell talks about probate fee

Many clients have enquired whether we can accept new Will instructions during this uncertain and difficult time.   Perhaps even more so now than ever, Wills need to be made and the government has recognised the importance of legal practitioners and their work in this area by classifying those involved in the execution of Wills as key workers.   It is therefore possible for us to continue to provide Wills for the majority of those who wish to make them,

Be Aware of Cyber-Crime - COVID19

As the COVID-19 crisis continues to significantly impact our daily lives, most communities are joining together to support one another.  However we are receiving increasing reports that the cyber-crime community is doing the exact opposite and that attempted frauds and scams are rocketing.  This appears to be an attempt to take advantage of the distraction caused by the crisis.   Please take precautions to ensure that you do not become a victim of cybercrime.   We advise all of our clients that online and
